Terms of use

1. Who we are

FlickerTalk is a service of ERPLORA CLOUD SL, NIF B27593136, Avda. de Lisboa, 17, Pta. C, 28822 Coslada (Madrid), Spain (“we”). Contact: info@flickertalk.com. By using FlickerTalk you accept these terms.

2. The service

FlickerTalk lets two people exchange text, files and voice and video calls from phone to phone. Our servers only wake phones, help them connect and keep undelivered messages, encrypted end to end, for up to 7 days. See How it works.

3. Your phone, your data

Your identity, your keys and your history exist only on your phone. You are responsible for your phone and for what happens on it. If you lose your phone, uninstall the app or erase it, we cannot recover your messages, your contacts or your identity: there are no backups.

4. Price

FlickerTalk is free for the first year, counted from the day you install it. After that it costs €1 per year for adults, paid through Google Play or the App Store under their terms. Under 18, it is always free.

5. Acceptable use

Do not use FlickerTalk to break the law or to harm others: no harassment, threats, spam, malware, content that sexually exploits children, or any other illegal content, and no attempts to overload, attack or misuse our servers. We cannot read your conversations, but you can block and report anyone, and we may stop serving devices used for abuse.

6. No warranty

FlickerTalk is provided “as is” and “as available”, without warranties of any kind, express or implied, to the extent the law allows. We do not guarantee that it will work without interruptions or errors, or that every message or call will be delivered: the other phone may be off, the network may fail, and the mailbox deletes messages after 7 days. FlickerTalk is not an emergency service and cannot call emergency numbers.

7. Use at your own risk

You use FlickerTalk at your own risk. To the extent the law allows, ERPLORA CLOUD SL is not liable for loss of data, messages or files, for indirect or consequential damages, or for the content that users send each other. Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence, or the rights that consumer protection law gives you.

8. Open source

The code of the app and the server is published under the AGPL-3.0 licence. These terms govern the use of our service; your rights over the code are those of the licence.

9. Changes and ending

We may change FlickerTalk or these terms; the new version will be published here with its date. You can stop using FlickerTalk at any time: erase the phone in Settings and uninstall the app. We may end the service, and would announce it here in advance.

10. Law

These terms are governed by Spanish law. If you are a consumer, you may also go to the courts of the place where you live.
